Subscription Terms

1. General Provisions

These Terms set out the rules for using the paid subscriptions offered in the Scintilla application. A subscription provides access to the Scintilla application. Purchasing a subscription constitutes acceptance of these Terms.

2. Payment Providers

Purchases are made through: • the Apple App Store (iOS devices), • the Google Play Store (Android devices). The Data Controller does not process users' payment card data. All payments are handled by the relevant app stores in accordance with their terms and privacy policies. Subscription management and verification of subscription activity are carried out through the RevenueCat system (https://www.revenuecat.com).

3. Types of Subscription

The application offers a monthly subscription. New users may take advantage of a 7-day free trial period. Upon its expiry, the subscription automatically converts to a paid plan according to the selected option. To avoid being charged, you must cancel the subscription at least 24 hours before the end of the trial period. Time-limited promotions may also be available from time to time. Current prices are presented in the application each time before a purchase is made.

4. Conclusion of the Contract

The contract for the provision of digital services is concluded upon confirmation of the purchase by the Apple App Store or the Google Play Store. From that moment, the user obtains access to the Scintilla application in accordance with the terms of the selected plan.

5. Right of Withdrawal

If you are a consumer residing within the European Union, you are generally entitled to withdraw from a contract concluded at a distance within 14 days of its conclusion. At the same time, in accordance with applicable law, the right of withdrawal may expire before the end of that period if: • the provision of digital services has commenced, • the user has consented to the commencement of the provision of services before the expiry of the withdrawal period, • the user has been informed of the loss of the right of withdrawal and has accepted this fact. By purchasing a Scintilla subscription, the user consents to the immediate commencement of the provision of digital services. To the extent permitted by applicable law, this may result in the loss of the right to withdraw from the contract once access to the purchased digital content has been obtained. The above provisions do not limit the user's rights arising from mandatory provisions of consumer protection law.

6. Automatic Renewal

Subscriptions renew automatically. This means that, upon the end of the current billing period, the relevant store may charge a further fee for the next subscription period. A subscription renews automatically unless automatic renewal is disabled at least 24 hours before the end of the current billing period. The renewal fee will be charged to the user's account within the 24 hours preceding the end of the current billing period. Automatic renewal takes place in accordance with the rules applicable in the Apple App Store or the Google Play Store.

7. Managing a Subscription

The user may manage their subscription at any time through their store account settings. Apple App Store: Settings → Apple ID → Subscriptions Google Play Store: Google Play → Payments and subscriptions → Subscriptions The Data Controller is not able to cancel a subscription on the user's behalf.

8. Cancelling a Subscription

Cancelling a subscription disables its automatic renewal. After cancellation, the user retains access to the application until the end of the paid billing period. No further fees are charged once a subscription has been successfully cancelled.

9. Price Changes

The Data Controller may change subscription prices. In the event of price changes, the procedures provided by the Apple App Store and the Google Play Store apply. Where required by law or by store rules, the user will be informed of a price change before it takes effect.

10. Refunds

Payment refunds are processed in accordance with the rules applicable in the store through which the purchase was made. Purchases in the Apple App Store: refund requests should be directed to Apple. Purchases in the Google Play Store: refund requests should be directed to Google or submitted in accordance with the procedure available in Google Play. The Data Controller is not able to issue refunds independently for purchases handled by Apple or Google.

11. Availability of the Application

The Data Controller makes every effort to keep the application continuously available. In exceptional situations, temporary interruptions may occur in connection with: • updates, • system maintenance, • technical failures.

12. Account Security

1. The user is responsible for maintaining the confidentiality of their login credentials. 2. For increased security, logging into your account on a new device ends all previous sessions on other devices. 3. After 5 failed login attempts, access is temporarily blocked for 60 seconds. If you did not make these attempts, we recommend changing your password. 4. The application offers optional biometric authentication (Face ID, Touch ID, fingerprint) to protect access to your account. Biometric data is processed exclusively by your device's operating system and is never transmitted to or stored by our servers. Whether biometric data is stored on your device and how it is protected depends on your device manufacturer and operating system.

13. Termination of the Service

In the event of the permanent discontinuation of the application, users will be informed with appropriate advance notice, where possible. This does not affect users' rights arising from applicable law.

14. Complaints

Complaints regarding subscriptions or access to the application may be submitted via the e-mail address indicated in Section 15. A complaint should include: • a description of the problem, • the date on which it occurred, • contact details enabling a response to be provided. We will examine the complaint and provide a response within 14 days of receiving it. Where a complaint requires additional clarification, this period may be extended — we will inform you of this without delay. The above does not limit your rights to pursue claims arising from generally applicable provisions of law.

15. Changes to the Terms

The Data Controller reserves the right to amend these Terms. Users will be informed of significant changes through the application at least 14 days before they take effect. Continued use of the subscription after the changes take effect constitutes acceptance of them. If you do not accept the new terms, you may cancel your subscription before the date on which they take effect.
